RECITALS
These Rules & Regulations shall govern this, Sweepstakes #24-0101. The words, “Sweepstakes,” “Contest,” and/or “Giveaway,” are used interchangeably and have one and same meaning herein. Capitalization of any of the letters of the specific aforementioned words have no special or particular meaning. The title of this Sweepstakes #24-0101 may also be referenced herein as “Sweepstakes,” “Contest,” and/or “Giveaway,” but in all cases shall always specifically reference this, “Sweepstakes #24-0101.” WestStar MultiMedia Entertainment, Inc. (herein, “we,” “us,” “our,” “the Administrator,” or “the Network”), is the Administrator and manager of this Sweepstakes #24-0101. To the greatest extent possible, we use our best efforts to make all of our contest rules consistent from one contest to the next. However, various contests may feature unique prizes which may often require certain and specific rules that may occasionally differ from previous contests in which we shall have acted as Administrator. These specific rules (and only these rules) shall govern the operation of this Sweepstakes #24-0101.
DATES OF CONTEST OPERATION
Sweepstakes #24-0101 shall begin on October 2nd, 2024, at exactly 12:01:00 a.m. Pacific Standard Time (UTC-7) and shall end on November 25th, 2024, at exactly 11:59:00 p.m. Pacific Standard Time (UTC-7) (herein, the “Promotion Period.”). No rules, actions, or inactions from past contests emanating from any entity whatsoever shall be considered or applied in this Sweepstakes #24-0101. Entries received prior to or after the Program Period shall not be recognized or accepted and shall be disregarded and destroyed.
AGREEMENT TO THESE OFFICIAL RULES.
Participation in this Sweepstakes #24-0101 constitutes the entrant’s (herein, “entrant,” “entrant’s,” “you,” “your, or “yours,”) full acceptance, unconditional agreement, and complete willingness to abide by these rules and also our Privacy Policy. (Please read our complete Privacy Policy which is located at https://www.komando.com/privacy-policy.) Odds of winning shall depend on the total number of eligible entries received during the Promotion Period.
ELIGIBILITY
To be eligible to win a prize in this “Sweepstakes #24-0101,” you must first enter precisely accordance with these Rules. This Sweepstakes #24-0101 is open only to legal residents of the United States, District of Columbia, and United States Territories (and only where permissible by law), by those who are of legal age of majority in the jurisdiction in which they reside (and are at least 18 years old at the time of entry). Proof of residency and age may be required. Employees, spouses, immediate family, and sponsors of The Kim Komando Show® or its affiliate broadcast stations, together with the employees and the immediate families of WestStar MultiMedia Entertainment, Inc.; WestStar Television Productions, Inc.; WestStar Affiliate Sales, Inc.; The Komando Corporation, Inc.; Barry Young Entertainment, Inc.; and its sponsors, advertisers, or any of the other companies or entities which may supply prizes or service to this contest may not enter and shall not be eligible to win a prize. The contest is subject to all applicable federal, state, and local laws, rules and regulations. Void where otherwise prohibited or restricted by law, rule or regulation. Entrants are eligible to win one (1) contest sponsored or operated by the Administrator herein within a ninety (90) day period.
ELIGIBILITY EXCEPTIONS
Exceptions to the Eligibility rule (supra), are hereby made for active-duty U.S. military personnel (and their immediate families) who are stationed outside the United States but who also have a valid A.P.O. or F.P.O. military mailing address. To enter using a military mailing address, please provide to us the name of entrant’s unit. In the address field (if any), enter the A.P.O. or F.P.O. in the “City:” field (if any), select the appropriate military “state” based on the theater of deployment:

HOW TO ENTER
Eligible personas (as fully described herein) may become an entrant and participate in this Sweepstakes #24-0101 through a submission form located on the website www.Komando.com. This is the only means of entering. Attempting to enter by any other means will result in an invalid entry. (No entries via email, U.S. mail, FAX, FedEx or similar services, personal deliveries, telephone, or any other means shall be accepted.) You may enter only one time. All entries become the sole property of the Administrator. One winner shall be determined by a drawing conducted by Kim Komando® or her authorized representative. Drawing shall be conducted on or about November 26th, 2024 at noon PST. The prizewinner’s name will be published on or about November 26th, 2024, on the www.Komando.com website. Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization, that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Administrator with proof that the potential winner is the authorized account holder of the specific e-mail address associated with the winning entry. The prize shall only be awarded to the authorized account holder. Prizes are not transferrable under any circumstances.
WAIVER OF LIABILITY AND PUBLICITY RELEASE
Winner or winners must execute and return to the Administrator an Affidavit of Eligibility/Release of Liability, and Permission for Publicity (herein, the “Affidavit”) (except in Tennessee or where otherwise prohibited by law), which shall be provided by the Administrator. If requested by Administrator, winner or winners must provide tax information as provided by law prior to receipt of Prize. Noncompliance within thirty (30) days of notification of winning may result in disqualification and an alternate winner may be selected. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
DISQUALIFICATION
Any attempt to circumvent any rule or rules of this contest in any way or manner whatsoever (in the sole opinion of the Administrator), shall result in immediate and permanent disqualification and could serve as the basis for further disqualification from future contests operated or controlled by the Administrator. If, in Administrator’s sole opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the contest, or if technical difficulties compromise the integrity of the contest, Administrator reserves the right (in its sole discretion) to void any entries at issue (including disqualifying any individual who tampers, or may have tampered with, or otherwise interferes with, or may have interfered with, the entry process), and to cancel, terminate, modify or suspend the contest, in whole or in part, at any time without prior or further notice. In the event of such cancellation, Administrator reserves the right to award the prize in a random drawing from all eligible entries received before the time of cancellation. Administrator in no way permits or promotes illegal acts, and any and all entries which include or promote illegal acts shall be summarily disqualified.
LIMITATIONS OF LIABILITY
Potential entrant’s ability to access the entry page of our website is a matter beyond our reasonable control, and we, therefore, shall have no responsibility or obligations for any real or perceived deficiency of the quality (or lack thereof) of any telephone or broadband or other communications service or internet service within any regions or areas across the United States of America or anywhere else. By participating in this contest you hereby forever and unconditionally release and hold harmless the Administrator; Kim Komando®; The Kim Komando Show®; WestStar MultiMedia Entertainment, Inc.; its publications whether electronic or otherwise, its broadcast station affiliates, it or their subsidiaries, all respective officers, directors, shareholders, agents, sponsors, suppliers, manufacturers, employees, and/or representatives and their successors, heirs, and assigns from any and all liability and harm or claims for damages or potential damages caused or allegedly caused by any failure of performance, defects or damages in products or workmanship, error, omission or interruption, deletion, delay in operation or transmission, computer virus, communication line failure(s), breakdown of equipment, software error(s), unauthorized access to, or theft, destruction or alteration, or any other failure(s) beyond Administrator’s reasonable control related in any way whatsoever to the receipt of any prize(s) awarded hereunder. You hereby specifically agree to forever release and hold harmless Kim Komando®; The Kim Komando Show®; WestStar MultiMedia Entertainment, Inc.,; its affiliates and affiliate stations, subsidiaries, their respective officers, directors, shareholders, agents, sponsors, suppliers, manufacturers, employees, and representatives; and their successors, heirs and assigns against any and all liability, claims, demands, damages and expenses (including attorneys’ fees) arising directly or indirectly out of the operation of, or any failure(s) beyond, our reasonable control in any part this contest. By entering the contest, you also forever waive any and all claims or cause of action against Administrator or any other related party (including class action or otherwise), arising out of your participation in this contest or receipt or use or misuse of any prize, including, but not limited to any injury or damage to persons or property, including death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the contest or receipt of prize, including without limitation, any cancellation or postponement of any prize, any malfunction of prize, any event or any travel or activity related to the receipt or use of any prize. Administrator (and all retaliated parties thereto) reserves the right to cancel or modify the contest in the event of fraud or suspected fraud or any other factor which does or could impair the integrity of the contest as determined by Administrator in its sole discretion. Prize winner(s) shall be required to complete and sign a Declaration of Eligibility and Liability/Publicity Release to receive all Prizes. Declaration of Eligibility and Liability/Publicity Release must be completed, signed and returned within thirty (30) days of receipt. We may publish the winner’s/winners’ name(s) at any time before, during and after the selection of the winner(s) on the Komando.com® website.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE ADMINISTRTOR PROVIDED NO WARRANTIES OF ANY KIND. THE PRIZE IS PROVIDED TO THE WINNERS (S), BRAND NEW AND “AS IS” FROM THE MANUFACTURER, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT (EXCEPT FOR THAT WHICH IS PROVIDED SOLEY BY THE MANUFACTURER TO THE END USER).

The prize may be upgraded by the Administrator at the Administrator’s sole discretion at any time. An awarded prize or prizes shall not be substituted, traded, exchanged or sold back to the Administrator for its equivalent (or less) cash value, nor shall it be modified in any way whatsoever from the descriptions listed herein, except as provided under these Rules. In any and all cases where there may be multiple prizes to be awarded to multiple winners, and the award, or the order of the award, of any of those prizes is not specifically described in these Rules, then the Administrator, in its sole determination, shall determine which prize shall be awarded to which winner(s), and in no case shall winner(s) or any other entity, make these decisions. In order to receive your prize, you hereby agree to accurately report to us any and all information that we shall be required by law to collect for tax purposes, including your Social Security number and/or Taxpayer Identification Number as noted below, infra.
PRIZEWINNERS/AWARDING PRIZE(S)
Prizewinner(s) will be notified within ten (10) days, if possible, using the information which he/she/they, as the entrant, provided to us, and we shall make all reasonable efforts to contact a winner using that information. However, the Administrator is not and shall not be held responsible for any incorrect information, regardless of the reason(s), even if is determined that the fault lies with the Administrator. If we are not able to locate or contact a prizewinner after a period of thirty (30) days from the conclusion of Sweepstakes #24-0101, that particular prize may be donated to a suitable charitable organization of our choosing or may be disposed of in any manner at the Administrator’s sole discretion. We will use our best efforts to deliver prizes to winners in a short and timely manner (estimated 2-3 weeks, but possibly up to 12 weeks). We shall not be responsible or obligated in any way whatsoever for any event or events that may delay shipment or deliveries of prizes to winners, and which are beyond our control. In addition, the Administrator shall have no liability whatsoever with respect to any shipping prohibitions or delays or any other laws, ordinances, rules or regulations from any jurisdiction, which could, in any way, prohibit, delay or interfere with Administrator’s ability to ship or to transfer any prizes to military or any other address. UNDER NO CIRCUMSTANCES SHALL ANY PRIZE OR AWARD BE SHIPPED OR TRANSFERRED TO AN ADDRESS OUTSIDE THE UNITED STATES OF AMERICA, AMERICAN SAMOA, PUERTO RICO, GUAM OR THE U.S. VIRGIN ISLANDS, except to active-duty U.S. military personnel (and their immediate families), as provided herein. In the event a prizewinner declines or refuses to accept the awarded prize(s) for any reason whatsoever, or in the event that notification of winning a prize cannot be accomplished within thirty (30) days of the first notification attempt, that prizewinner shall be disqualified, and the Administrator may select an alternate prizewinner for that particular prize or dispose of as described herein supra.
TAXES AND REQUIREMENTS TO SUPPLY REQUIRED TAX INFORMATION
The winning of a prize, especially a prize of high monetary value, may have certain tax ramifications for you. As required by federal and state laws, we may issue you an I.R.S.1099 in the amount of the Manufacturer’s Suggested Retail Price (herein, “M.S.R.P.), as stipulated by the manufacturer or supplier of the prize. If so, we will be required by U.S. federal law to report to the I.R.S. the value of your winnings. The value of any prize awarded hereunder shall be the published M.S.R.P. in effect as of the date the prize is awarded. As noted about herein, in to receive a prize, entrants hereby agree to accurately report to us any and all information that we shall be required by law to collect for tax purposes, including your Social Security number and/or Taxpayer Identification Number. In the event that you fail to provide this legally required tax information to us, we may, at our sole discretion and option, cancel the prize awarded to you. In such an event, you agree that you shall have no recourse against us, and you hereby release and hold harmless Kim Komando®; The Kim Komando Show®; WestStar MultiMedia Entertainment; its affiliates and affiliate stations, subsidiaries, their respective officers, directors, shareholders, agents, sponsors, suppliers, manufacturers, employees, and representatives, and their successors, heirs and assigns against any and all liability, claims, demands, damages and expenses forever (including attorneys’ fees), and that we shall have no further obligation to you in any way whatsoever. At the time of the writing of these rules, U.S. federal law requires that the tax or taxes which are due on any prize valued at $600.00 or greater must be collected from winners through an I.R.S. procedure, not directly involving the Administrator herein, before the award and distribution of the prize; however, all federal and state withholding laws are subject to change without notice. The tax withholding laws which are in effect at the time of a prize award or distribution will be followed by the Administrator. Check with your financial advisor for additional information and how the awarding of any prize as described herein can affect you. (NOTICE: Should this $600.00 federal threshold requirement change, then such change shall be incorporated into these rules herein to the extent necessary to conform to the law.)
YOUR PRIVACY AND OUR RIGHTS TO PUBLICIZE PRIZEWINNER INFORMATION Except where prohibited by law, the Winner grants to Administrator and its advertising agencies the right to use and publish Winner’s photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote the contest without additional compensation. By entering the contest, you forever waive any and all claims or cause of action against Administrator, and each of its (and their|) respective parent companies, subsidiaries, affiliates, owners, members, shareholders, directors, officers, employees and agents (each a “Releasee” and collectively the, “Releasees”) arising out of participation in the contest or receipt or use or misuse of any prize, including, but not limited to any injury or damage to persons or property, including death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of Prize, including without limitation, any cancellation or postponement of any Prize event or any travel or activity related to the receipt or use of any Prize. By entering and/or accepting any awarded prizes hereunder, and for good and valuable consideration to be transferred from the Administrator (namely, the privilege to enter to win and to possibly receive any prize awarded in the operation of Sweepstakes #24-0101), you hereby grant to us an irrevocable, perpetual, unlimited and ongoing right to utilize any and all of your information provided to us by you, as described herein, and without any further notice or obligation to you in any way whatsoever. You further hereby specifically agree that the use of your information by the Administrator, prize suppliers and/or sponsors of Sweepstakes #24-0101 in any way and through any means now known or later devised shall not be deemed or considered a violation of any of your privacy or intellectual property rights in any way whatsoever. Further, as a prizewinner, you hereby agree that we and our prize suppliers and/or our sponsors may use, for promotional purposes and in ways to be determined by the Administrator, your photograph, name, voice, face and/or likeness, your city and state of residence, the description and value of the prize that you shall have won hereunder, and your local radio station information (herein, “your information”). Information such as your telephone number and street address will not be made public. We may, from time to time, use your information over the air, online and in print as we, in our sole judgment and discretion, see fit and deem to be appropriate and necessary. The validity and operation of this rule shall survive and continue in full force and effect past the ending date of Sweepstakes #24-0101 and shall inure to the benefit of the Administrator, sponsor(s), its affiliates and affiliate stations, subsidiaries, their respective officers, directors, shareholders, agents, suppliers, manufacturers, employees, and representatives, and their successors, heirs and assigns, in perpetuity.
REVISION OF RULES
The Administrator hereby reserves the right to make minor modifications and/or revisions of these Rules (as may be required by law of circumstances beyond control of the Administrator) at any time during Sweepstakes #24-0101 by the act of publication at this web location and without any further notification. Rules shall be considered revised and/or updated upon their publication. At such a time, all prior rules shall be rendered null and void and shall not be enforceable in any way whatsoever.
JURISDICTION, CLASS ACTION WAVER
Participants in the contest hereby consent to the exclusive jurisdiction and venue of Arizona courts (state and federal) in Maricopa County for any causes or controversies arising out of the contest. Winner specifically waives any and all jurisdiction or venue in any other courts. Entrants hereby specifically agree that any and all issues, concerns, and/or questions, concerning these Rules, the operation of Sweepstakes #24-0101, or the rights and obligations of entrants or the Sponsor(s) or Administrators in connection herein shall be governed pursuant to applicable U.S. Federal Law and the laws of the State of Arizona without giving effect to any choice of law or conflict of law principals or rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Arizona. Should any dispute or litigation arise out of the operation these Rules, entrants hereby agree and concede that there shall be no Arbitration. Rather, the party claiming the dispute must contact the other party and attempt good faith negotiations for ten (10) days to resolve said dispute. Should good faith negotiations fail, then the claiming party may seek redress in a court of appropriate jurisdiction which shall be located within Maricopa County, Phoenix, Arizona. Claimant must pay and bear all of their costs of travel and lodging to Phoenix, Arizona. This rule is binding upon all entrants, whether they are a winner or not, and whether or not the matter of winning is in dispute. The prevailing party shall be entitled to all reasonable legal and courts cost up through any appellate. By entering the contest, you forever waive any and all claims or cause of action against Administrator, promoter, or any companies or prize providers associated with the contest and each of its and their respective parent companies, subsidiaries, affiliates, owners, members, shareholders, directors, officers, employees and agents (each a “Releasee” and collectively the, “Releasees”) arising out of participation in the contest or receipt or use or misuse of any prize, including, but not limited to any injury or damage to persons or property, including death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of Prize, including without limitation, any cancellation or postponement of any Prize event or any travel or activity related to the receipt or use of any Prize.
WAVER OF RIGHTS
Entrants hereby specifically agree that neither the Administrator nor its Sponsor(s) shall be held liable in any way whatsoever for any delay or failure in performance of any part of Sweepstakes #24-0101 from any cause beyond its control, fault, or negligence, including, but not limited to, acts of civil or military authority; government regulations; embargoes; epidemics; war; terrorist acts; riots; insurrections; fires; explosions; nuclear accidents; strikes; lockouts; extended power blackouts; natural disasters such as earthquakes, floods, volcanic activity, widespread destruction or disruptions, unusually severe weather conditions, or other major environmental disturbances; inability to secure transportation facilities; failure or partial failure of software or hardware products or the services of other persons; acts or omissions of transportation or communications; common carriers; and legal and/or regulatory constraints affecting the Administrator or its sponsor in their performance of their obligations hereunder (herein, “Force Majeure”). Entrants hereby specifically agree that any and all claims and/or causes of action which arise or could arise from, or in connection with, Sweepstakes #24-0101, shall be resolved individually, and without resort to any form of class action, and that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with Sweepstakes #24-0101, but in no event shall such damages include attorneys’ fees. Each entrant (and/or entrant’s parent/legal guardian if entrant is a minor) hereby waives all rights to punitive, incidental, consequential or any other damages other than actual out-of-pocket expenses. No entrant (and/or entrant’s parent/legal guardian if entrant is a minor) shall claim or receive any damages subject to being multiplied or otherwise increased. Entrants hereby specifically agree that the Administrator is now and shall forevermore be the sole interpretative and final authority as to these rules and as to the operation of Sweepstakes #24-0101. The Administrator’s decisions hereunder are final. Should there be any conflict or potential conflict with any rule herein, then that conflict shall be resolved by the Administrator in the Administrator’s best interests.
In the event that any rule or any provision of Sweepstakes #24-0101 is found to be in conflict with any state, municipal or governmental statute, regulation or law, then that rule (or rules) shall be deemed changed as necessary to conform to all statutes, regulations or laws, if possible. If not possible, then this entire Sweepstakes #24-0101 shall be deemed to be void in that jurisdiction or municipality, and those living in that jurisdiction or municipality shall be deemed ineligible to participate or win hereunder, even if they have entered into this contest giveaway. Such decisions shall be made at the sole discretion of the Administrator. In such an event, neither the validity nor enforceability of any other rule in Sweepstakes #24-0101 shall be affected in any way whatsoever and shall remain in full force and binding effect. These rules are the full and complete rules and hereby supersede, nullify and void any and all prior rules regarding to sweepstakes #24-0101.
USE OF DATA
Administrator may be collecting personal data about participants (including, without limitation, name, phone number, mailing address, gender, age e-mail addresses). It is hereby agreed that upon entering, the Administrator is entitled to use personal data contained in all entry forms in accordance with the Administrator’s privacy policy. All information submitted online by entrants is subject to and will be treated in a manner consistent with Administrator’s Terms of Use which is incorporated herein by reference. Notwithstanding any contrary provision in the Administrator’s privacy policies, entrants grant to the Administrator, and the Administrator reserves, the right to use any and all information related to the contest, including information provided by entrants in connection with the contest, for any purpose, unless prohibited by law. Entrants may be required to sign a release, which grants the Administrator the right to use and publish their proper name online or in any other media in connection with the contest. In order to accept a prize, entrants (excluding from Tennessee and where otherwise prohibited by law), shall be required to sign a release that grants permission to the Administrator to use his or her name, photograph, likeness, prize information and/or biographical information without future compensation.

Sweepstakes #24-0101 is not a part of any other sweepstakes, contests or promotions and is conducted primarily via the Internet. It may be mentioned or referenced on the air on The Kim Komando Show® and its broadcast affiliates. Nevertheless, to the best of the Administrator’s ability and knowledge, Sweepstakes #24-0101 conforms to National Association of Broadcasters’ (NAB) guidelines pertaining to radio Contests and Sweepstakes and all applicable FCC rules, regulations and requirements (47 C.F.R – 73.1211).

WINNER LIST

Winner list requests must be received within sixty (60) days of the conclusion of the contest or after the winner has been announced.
